When to cars get together at the same time they usually end up with some sort of damage. Generally called property damage. Property damage is usually resolved through the assistance of an insurance company. Either your own or the insurance company of the person who caused the damages to your vehicle. But many times dealing with the property damage is a very frustrating experience. Because the damage to the vehicle often does not get fully repaired. Or the value of the vehicle in the case of a total loss does not seem to be sufficient. Many times we drive cars that are way beyond their years because we have taken good care of them and they operate fairly well. But the insurance companies or even the law does not really recognize the value necessarily. In the case of a damaged vehicle, the law basically says that you take the value of the vehicle before the accident and you take the value of the vehicle of the accident after the accident and that is the damage to your vehicle or the value of your vehicle. If the damage can be repaired then it is the cost of that repair if and in fact it is less then the damage in value. That is a little confusing already. But that is the way that some of this works. It is some what confusing. If you have had damage to your car and your car can be repaired then take it to your own insurance company or have the insurance company of the opposing side get it repaired or pay for those damages. But if your vehicle has been a total loss as a result of the accident in other words the value or the cost to repair the vehicle is to great or to much to offset the differential or off set the cost of the repairs then you are going to have to figure out how to get the best return back from the insurance company so you can go get a replacement vehicle. Again this is somewhat a frustrating experience for some of you and many clients and many individuals because the insurance company wants to pay as little as possible and of course we want to get as much as possible for the value of our car so you can replace it. So here are a couple of keys. Number one, make sure you unutilized a good repair shop to give a good estimate and to repair the car properly. Number two, if your car is fully damaged and it cannot be repaired, we call that a total loss, then you want to make sure that you get real value for the loss of your vehicle. You want to find out what the cost to replace your vehicle would really be, the fair market value and then negotiate with the insurance company to get the best return possible. You may never get exactly what you wanted and that is an unfortunate situation. But if you first have gotten your own insurance, you are aware of what the value of your vehicle is and that you successfully negotiate with the insurance company to get the best result possible, then you probably will come out all right.
