There are two very important reasons why you would want to videotape the defendant’s deposition during a medical malpractice case, an accident case or a car accident case here in New York.
First, what is a deposition?
A deposition is pretrial testimony, which is also known as a question and answer session, given under oath, in a lawyer’s office.
During the course of a lawsuit where you are seeking compensation for the harms and losses you suffered because of someone else’s carelessness, I have an opportunity to question the people that you have sued.
During pretrial testimony, all the questions I ask and all of the answers that are given by the witness will be recorded and transcribed by a court stenographer. That transcription will be put into the form of a booklet known as a deposition transcript.
However, there are some key instances where having the witness videotaped while being questioned during pretrial testimony can be extremely helpful at the time of trial.
One reason why we would want to videotape pretrial testimony is if we expect that the witness will not be available at the time of trial.
That could be because the witness might be unavailable, has skipped town, disappeared, or died.
