Finding an attorney who can help an owner, CEO, or president manage business issues can be a stressful situation if not approached correctly.  Here are five recommendations about what to look for when hiring an attorney, and when an attorney should be engaged (hint: sooner than later).

A legal analysis of Frank Castle’s trial from season 2 episode 7 and 8 of Marvel’s Daredevil. It’s finally time for the Punisher to stand trial, and thanks to just about every imaginable thing going wrong, Nelson and Murdock must defend him against District Attorney Reyes, who has a stacked deck and enough clout to steamroll our favorite tiny firm with ease.”

The trial starts with jury voir dire. For inexplicable reasons the judge is mad at counsel for their inability to find an unbiased jury. Things go off the rails from there. At lot of good procedure, but right off the bat, the judge should have declared a mistrial. Still, fun to talk about reserving opening statements, federal rules of evidence, and expert cross examinations.

I get asked a lot about whether being a practicing attorney is like being a lawyer on TV. I love watching legal movies and courtroom dramas. It’s one of the reasons I decided to become a lawyer. But sometimes they make me want to pull my hair out because they are ridiculous.

Today I’m taking a break from representing clients and teaching law students how to kick ass in law school to take on lawyers in the movies and on TV. While all legal movies and shows take dramatic license to make things more interesting (nobody wants to see hundreds of hours of brief writing), many of them have a grain of truth.

Today, I wanted to make this video for you guys because day after day I get comments from people who are having problems with their immigration attorney or because of their immigration attorney. Here are a few tips that I believe will help you find immigration lawyer that will be right for your immigration process.

Keep these two principles in mind when you search for immigration attorney:

1. Know your case
2. You are the boss

How to find immigration lawyer in 5 steps:
1. Use Online resources
Search Google, Bing or whatever you use to research web for keywords like “immigration lawyer near me,” “immigration law firms near me,” “immigration law office near me,” “best immigration lawyer near me,” “immigration lawyer free consultation near me,” and/or “immigration attorney near me.” You can also search for “Avvo immigration attorney,” because Avvo is a pretty good source to find attorneys, view their ratings and even contact them directly.
Also, you might try being a little more case specific to find the immigration attorney that has more experience in the right area, like “green card immigration lawyer.” Also, area specific search might give you better results, for example: “immigration lawyer Orlando.”

2. Make a list of 10 attorneys that you like the most… Call all of them!
3. Set up consultations with at least 5 of them. Keep in mind the immigration lawyer free consultation part.
4. After consultation, pick the top 3 to choose from. If you don’t have top 3, continue your search.
5. Know and negotiate the prices and terms of contract.

Tips to find the best immigration attorney, make sure that he/she:
1. Talks to you on the phone. Doesn’t keep his/her cards closed.
2. Offers free consultation.
3. Does not guarantee anything.
4. Does not try to scare you into hiring him/her.
5. Doesn’t make you feel stupid.
6. Upfront about terms of contract and prices.
7. Does not charge unlimited hours and hidden fees.

Well, I think a lot of it has to do with how you find a good lawyer in general. I think DUI’s is a little niche within criminal defense.
0:24 So the first thing you want to do is make sure you list down an attorney who is presentable, an attorney who is not going to hurt you with their poor reputation. Because a lot of attorneys are hacks, who call themselves criminal defense attorneys whether it’s because they can’t get a job doing other stuff and think it’s easy to do criminal defense, which is not or people were just not good attorneys, not good advocates, not good representation of the people they’re supposed to be representing.
0:55 You want to hire an attorney who has been around, who has good experience, who has a good reputation and who is presentable and approachable. Someone who either themselves or their staff, you can get a hold of and have your questions answer in a timely manner whether it is felony DUI or whether it is a first time DUI. Your case is important and you want to make sure you have an attorney who surrounds himself with the right people. Who has that experience, trial experience, motion experience is very important as well.
1:25 I have my fair share of DUI jury trials. I have done my fair share of suppression motions, issues related to DUI cases. A lot of attorneys may claim to be DUI attorneys and they might have done one or two DUI trials in their career. We are all there at one point in time. I’m not mocking them for that. They are going to need to go out there, work, and hustle. From your perspective, all of us being equal, that attorney charge this much and another attorney with a lot more experience who is charging that much. You could do both. Hire a better attorney with a practical in-court experience.
1:58 Another thing to be weary of is there are attorneys out there and say, “I’ve been in practice for 25-30 years. Why are you going to hire someone like David Shapiro who’s been just practicing for 7 years?” You are going to look at not how long that person has been in practice, not how long he has been in practice but how many cases they have done. So if I have over thousand cases in my career and some guys who’ve been doing 25 years is on 500 cases, who are you going to hire? You should hire the attorney who has more experience, more value not just years in practice. Well you can do years in practice doing wills and trusts for the state, you can do years of practice playing golf, you can do years in practice doing civil defense stuff, not DUI defense, not criminal defense.
